VIRTUAL DISPUTE RESOLUTION CHECKLIST

We have developed this pre-hearing checklist to assist in a smooth and successful experience for you and your clients.

EXCHANGE CONTACT INFORMATION

    • Provide a list of contact information for each person in your party to the mediator.  This will assist in the event a participant loses access to the mediation.  Please include the following:
      • Name
      • Cellphone number
      • Email address
      • Role (i.e. attorney, represented party, insurance carrier representative, etc.)

 

TEST YOUR ZOOM

      • Download the Zoom application to your computer, or other device.
      • Test your computer’s ability to use Zoom prior to your meeting. To be adequately prepared, join a Test Meeting at https://www.zoom.us/test.
      • You will then be able to test your internet connection, sound, video and lighting.
      • Please be certain that each person in your party tests their Zoom capabilities using the above protocols.

 

PRIVACY AND CONFIDENTIALITY

      • Select a private location.  Be certain that that you are in an enclosed, private room free from onlookers and distractions.
      • Absolutely no third parties are allowed to be present during the session.
      • Be sure that your internet connection is secured. Do not ever use a public wi-fi network.

 

SHARING DOCUMENTS

      • Send your mediation briefs and any other relevant documents confidentially to Judge Padrick at least a week prior to the mediation.
      • Decide which documents, if any, you intend to share on-screen during the hearing.
      • To make things simpler, have those documents already open on your computer when the session commences.

 

FOR A SMOOTH HEARING

      • Confirm that all participants have blocked enough time off for the mediation and are fully prepared to participate in the meeting.
      • Let Judge Padrick know in advance who is allowed in your break-out room.
      • Use DocuSign or a scanner to submit settlement agreements or other confidential documents.
      • Dress appropriately in the event the camera moves to places you might not have envisioned.
      • Make certain to always look directly at the camera for rapport with the mediator and your clients.
